Overview

Acting as independent authority, Insolvency Service supervises over the activities of the debtor and persons connected with it in connection with bankruptcy proceedings of the assetless debtor. It is also responsible among others for administrative supervision of the bankruptcy trustees in Estonia. Insolvency Service is independent in its activities with autonomous competence provided by Bankruptcy Act of Estonia and has its own budget. Insolvency Service is led by dr. Signe Viimsalu.
THE INSOLVENCY service:
  1. submits information to the court for the application of a business ban (management disqualification) in bankruptcy proceedings.
  2. investigates the behavior of the assetless legal person and its connected persons in causing the debtor’s insolvency and payment difficulties. If it becomes apparent that a person has committed an act with characteristics of a criminal offence in connection with the emergence of insolvency, Insolvency Service notifies the prosecutor’s office or the police for the purpose of deciding on the initiation of criminal proceedings.
  3. carries out limited administrative supervision over bankruptcy trustees with regard to the lawful conduct of bankruptcy proceedings and the expediency of bankruptcy costs.
  4. contributes to the development of uniform insolvency practice in bankruptcy and restructuring proceedings, as well as in debt restructuring proceedings and proceedings for the discharge of obligations of a natural person.
