THE INSOLVENCY service:
- submits information to the court for the application of a business ban (management disqualification) in bankruptcy proceedings.
- investigates the behavior of the assetless legal person and its connected persons in causing the debtor’s insolvency and payment difficulties. If it becomes apparent that a person has committed an act with characteristics of a criminal offence in connection with the emergence of insolvency, Insolvency Service notifies the prosecutor’s office or the police for the purpose of deciding on the initiation of criminal proceedings.
- carries out limited administrative supervision over bankruptcy trustees with regard to the lawful conduct of bankruptcy proceedings and the expediency of bankruptcy costs.
- contributes to the development of uniform insolvency practice in bankruptcy and restructuring proceedings, as well as in debt restructuring proceedings and proceedings for the discharge of obligations of a natural person.
